MOVEMBER GENERAL TERMS

This section sets out the terms that apply to your use of the Movember website. Your continued use of our website indicates to Movember that you agree with these General Terms. We may change these General Terms from time to time, so please check back regularly.

1. Content created by Movember - Movember owns or licences from third parties all of the trademarks, copyright and other intellectual property that exists in our website. You must not copy or reproduce in any form any of the graphics, logos or other material on our website unless you have our specific permission. For the avoidance of doubt, you have our permission to download material from the Downloads page on our website.
    
2. Content posted by you - Any content that you post to our website (eg photos and videos) is your responsibility, and you must make sure that you have the necessary rights to post that content (eg by obtaining permission of copyright owners if necessary). By posting any content, you also give Movember a non-exclusive, transferable, royalty-free worldwide right to use and reproduce that content.
    
3. Keeping our website safe – We need your help to keep our website safe. Therefore, you must adhere to the following:
   
   a. You must not collect user’s content using automated means
   
   b. You must not upload viruses or other malicious code
   
   c. You must not bully, intimidate or harass anyone
   
   d. You must not post any content that infringes or violates someone else’s rights, or otherwise violates the law, or that is hateful, threatening, pornographic or violent
    
4. Movember’s disclaimer – Movember takes great care with its website and we endeavour to keep it accurate, error-free, and free of any offensive material. However, you use the site at your own risk and Movember will not be liable for any costs or losses you incur through your use of our website. Whilst we may include on our website links to third party websites or resources, Movember is not responsible for such third parties and you use those websites or resources at your own risk.
    
5. Hosting a Mo Party – if you register to host a Mo Party, we are happy to provide you with the materials in the Mo Party Kit, but organising and running the Mo Party is your responsibility. You will be responsible for taking care of all permits, permissions or other similar issues arising from the Mo Party that you organise and Movember will not have any liability in relation to any injury, damage or loss at a Mo Party.
    
6. Gala Parté Tickets – if you attend a Gala Parté, you will need to comply with the terms that are printed on the tickets.
    
7. Refunds – Movember is happy to refund your donation if you have made it in error. If you wish to request a refund then please contact us using the contact details in the Contact Us section of the Movember website relevant to the country in which you live.
    
8. Movember’s rights - Movember may remove any content posted by you, or prevent access by you to our website if you do not comply with these General Terms. Any failure by Movember to enforce our rights under these General Terms if you do not comply is not a waiver and we remain entitled to enforce our rights in relation to that or any other non-compliance by you.
    
9. Entities and governing law – the Movember entity and relevant law governing these General Terms depends on the country in which you live:
   
   a. If you live in the USA, these General Terms form an agreement between you and Movember Inc. subject to the laws of California, USA;
   
   b. If you live in Canada, these General Terms form an agreement between you and Movember Canada, subject to the laws of Ontario, Canada;
   
   c. If you live in a country that forms part of the European Union, then these General Terms form an agreement between you and Movember Europe, subject to the laws of England and Wales; and
   
   d. If you live in Australia, or in any other place not covered by paragraphs a, b, or c above, then these General Terms form an agreement between you and The Movember Group Pty Ltd, subject to the laws of Victoria, Australia.
    

TERMS & CONDITIONS – MOVEMBER EUROPE £50 DRAW

1. Entry into this competition is deemed acceptance of these terms and conditions.
    
2. The competition commences on 15 September 2011 and concludes at 10pm (GMT) on Friday 9th December 2011.
    
3. Mo Bros and Mo Sistas who register at www.movember.com and raise more than £50 for Movember are automatically entered into the competition and notified of this by Movember via email. There is a limit of one entry per Mo Bro and Mo Sista.
    
4. Employees and related parties of Movember are not eligible to enter.
    
5. Movember reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process.
    
6. The winner will be determined by a random draw of valid competition entrants. This will take place at approximately 10.00pm (GMT) on Friday 9 December, 2011 at the premises of Movember or its authorised agent at 178 Albert Street, Windsor, 3181, Australia.
    
7. There is one prize package to be won. The prize package is a flying experience day for two with The Blades flying team at Sywell Aerodrome, including one night’s accommodation and dinner. Total prize package is worth £3000
    
8. The prize is not redeemable for cash or other products and is not transferable. The prize can only be claimed by verbal or written acceptance by the winner. The prize must be taken by 31 December 2012 and must take place on a week day. The Blades reserve right to change date of flights. Accommodation and dinner to be agreed upon and confirmed subject to availability. Accommodation and dinner is not to exceed £250. Minimum age 12; max height 6’8”; max weight 18st. Medical restrictions must be declared and limit or preclude flight e.g. pregnancy, heart condition. Cancellation/postponement only on medical grounds
    
9. The winner will be notified by email on Friday 9 December, 2011. The name and town of the winner will be published on the website www.movember.com by Monday 12 December, 2011 and will be included in Movember’s broadcast email on 15 December 2011.
    
10. If the prize is not claimed by Thursday 15 December 2011 the prize will be forfeited and Movember will award the prize to another entrant, drawn randomly in the same manner as set out in condition 6.
     
11. If for any reason this competition is not capable of running as planned, then subject to any compulsory law to the contrary Movember reserves the right to cancel the competition.
     
12. All entries become the property of Movember. All information contained in the entries and details of the winner will be held in accordance with the Movember Privacy Policy, which can be accessed by visiting www.movember.com
     
13. The promoter is Movember Europe, Level 2 & 3, Gensurco House, 50a Rosebury Ave, Clerkenwell, EC1R 4RP.

TERMS & CONDITIONS – MOVEMBER EUROPE £100 DRAW

1. Entry into this competition is deemed acceptance of these terms and conditions.
    
2. The competition commences at 9am on 15 September 2011 and concludes at 10pm (GMT) on Friday 9 December 2011.
    
3. Mo Bros and Mo Sistas who register at www.movember.com and raise more than £100 for Movember are automatically entered into the competition and notified of this by Movember via email. There is a limit of one entry per Mo Bro and Mo Sista.
    
4. Employees and related parties of Movember are not eligible to enter.
    
5. Movember reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process.
    
6. The winner will be determined by a random draw of valid competition entrants. This will take place at approximately 10.00pm (GMT) on Friday 9 December, 2011 at the premises of Movember or its authorised agent at 178 Albert Street, Windsor, 3181, Australia.
    
7. There is one prize package to be won. The prize package is 7 nights for two at Nonsuch Bay Resort, Antigua in a luxury one bedroom apartment, full breakfast daily, the resort’s Sailing Plan, private airport transfers to and from the resort and return economy flights for two from London Gatwick to V.C Bird International. Total prize value is £6000.
    
8. Outbound travel is valid until 28 February 2013 subject to availability. Excluded dates include but are not limited to all school half term dates throughout 2012, as well as the following: 17th Dec 2011 to 7th Jan 2012, 31st Mar 2012 to 14th Apr 2012 and15th Dec 2012 to 5th Jan 2012.
    
9. 7 nights to be taken consecutively. The voucher is not transferable and not for resale, accommodation to be used by the prize winner and their travelling companion. Not available for use against or in conjunction with an existing booking. The Prize Winner and companion will be responsible for their own insurance requirements. Changes are unable to be made once the booking is confirmed. Bookings must be made at least 30 days before travel. Winners will need to provide proof of age before booking can be confirmed. Airline tickets will not be issued until the week of travel.
    
10. The resort Sailing Plan includes use of the resort’s sailboats by each guest over 7 years old. Use of the sailboats is conditional on the Waterfront Manager’s reasonable assessment of the guest’s sailing ability, the type of sailboat and weather conditions. If the guest needs to be accompanied by a member of the Waterfront Team, sailing time will be subject to staff availability. Tuition is available at extra cost to improve the sailing ability and help guests reach require competency levels. Participation in sailing and water sports is at the guests own risk.
11. Prize is valid for a maximum of two people. Return economy flights from London Gatwick to Antigua for two adults will be provided by the Antigua and Barbuda Tourism Authority, subject to availability. Prize winner and companions are responsible for any and all additional expenses not listed as part of the prize package above.
     
12. Prize winner and companions are required to provide: valid passports (at least 6 months to expiry date), visas (not required for British passport holders) valid and adequate travel insurance, airport transfers within the UK, departure tax from Antigua (US$28 per person).

14. The winner will be notified by email on Friday 9 December, 2011. The name and suburb of the winner will be published on the website www.movember.com by Monday 12 December, 2011 and will be included in Movember’s broadcast email on 15 December 2011.
     
15. If the prize is not claimed by Thursday 15 December 2011 the prize will be forfeited and Movember will award the prize to another entrant, drawn randomly in the same manner as set out in condition 6.
     
16. If for any reason this competition is not capable of running as planned, then subject to any compulsory law to the contrary Movember reserves the right to cancel the competition.
     
17. The competition organisers are not liable for and accept no responsibility for any direct or indirect loss, financial loss, consequential loss, loss of enjoyment, pain and suffering, damage, injury, accident delay or irregularity occasioned to the winner, whether caused by act, omission, negligence or otherwise, arising during the holiday prize stated.
     
18. The competition organisers will not be liable in the event that the winner is unable to travel, including without limitation, for any loss or damage resulting from any delay, cancellation, adverse weather conditions, loss of personal belongings, illness, bodily injury, accident, death, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical, due to an act of God or Force Majeure or third party wrongdoing, or any other causes beyond the reasonable control of the competition and could not reasonably be foreseen, anticipated or predicted, whether actual, threatened or reported.
     
19. All entries become the property of Movember. All information contained in the entries and details of the winner will be held in accordance with the Movember Privacy Policy, which can be accessed by visiting www.movember.com

RFU WINE CLUB PRIZE TERMS

1. The RFU Wine Club will provide an appropriate quantity of wine for tasting but will not accept any charge for corkage, chilling or serving.
    
2. RFU Wine Club requires appropriate facilities to be available for the secure storage of the wines once they have been delivered and also for chilling purposes.
    
3. The RFU Wine Club requires an appropriate sized room to carry out the tasting and would not conduct the said tasting in a general office/concourse area.
    
4. RFU Wine Club does not accept responsibility for any wines spilt or damage caused at the tasting.
    
5. In the event of the tasting needing to be cancelled the RFU Wine Club requires five working days notice.
    
6. In the event the number of people at tasting exceeds 25 the RFU Wine Club reserves the right to charge for any other persons attending.
    
7. Right of admission is reserved (R.O.A.R). In particular, the RFU Wine Club reserves the right to ask persons to leave the tasting for any reason including, without limitation, behaviour likely to cause nuisance or annoyance or for failure to comply with the reasonable requests of the RFU Wine Club or its representatives staffing the Event.
    
8. In order to attend the RFU Wine Club tasting, you must be over 18 years of age – proof of identity and age must be provided if requested

    

ADRENALIN JUNGLE WEEKEND PRIZE TERMS

1. The prize is subject to availability and may be substituted if not available.
    
2. All participants must be over the age of 18.
    
3. All participants take part at their own risk. Movember will not be liable for any loss, damage or injury arising from the prize.
